1. About Retro Exchange

Retro Exchange (“the Platform”) is a marketplace that connects buyers seeking retro video games with traders who can supply them. Retro Exchange acts solely as an intermediary platform and is not a party to any transaction between buyers and traders.

2. Platform Role & Limitation of Liability

Retro Exchange provides a venue for buyers and traders to connect. We do not inspect, verify, guarantee, or warrant any games, products, or services offered by traders. Retro Exchange is not responsible for:

• The quality, condition, authenticity, or description accuracy of any item
• The ability of traders to complete transactions
• The ability of buyers to pay for items
• Any loss, damage, or injury arising from transactions between users
• Any disputes, claims, or disagreements between buyers and traders
• Delivery delays, lost items, or shipping damage
• Any financial loss resulting from use of the Platform

To the fullest extent permitted by law, Retro Exchange disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising from use of the Platform or any transaction facilitated through it.

3. Disputes Between Users

All disputes arising from transactions must be resolved directly between the buyer and trader involved. Retro Exchange may, at its sole discretion, assist in facilitating communication between parties, but is under no obligation to mediate, arbitrate, or resolve any dispute.

By using the Platform, you agree that you will not hold Retro Exchange liable for any outcome of a dispute with another user. You acknowledge that Retro Exchange has no control over the actions of other users and cannot guarantee that any dispute will be resolved to your satisfaction.

4. User Accounts

You are responsible for maintaining the security of your account credentials. You agree not to share your account or use another user's account. Retro Exchange reserves the right to suspend or terminate any account at its sole discretion, without notice, for any reason including but not limited to violation of these terms.

5. Trader Accounts

Trader accounts enable users to browse buyer wants and make offers. By upgrading to a trader account, you represent that you are legally able to sell the items you offer. You are solely responsible for ensuring your offers are accurate and that you can fulfil them. Misrepresentation of items may result in account suspension.

6. Payments & Transactions

All financial transactions are conducted between buyers and traders. Retro Exchange does not process payments, hold funds in escrow, or guarantee any payment. Users are responsible for arranging payment methods and ensuring the security of their financial information.

7. Prohibited Conduct

Users must not:

• Post fraudulent wants or offers
• Misrepresent the condition or authenticity of items
• Harass, threaten, or abuse other users
• Attempt to circumvent Platform features or security measures
• Use the Platform for any illegal purpose
• Create multiple accounts to manipulate the marketplace

8. Indemnification

You agree to indemnify, defend, and hold harmless Retro Exchange, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Platform or any transaction you enter into through it.

9. Modifications

Retro Exchange reserves the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of England and Wales. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of England and Wales.
